The Regulations also contain information that the Seller is obliged to provide to the Consumer in accordance with applicable regulations, including the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2017.683 t.j., as amended). <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Each customer should familiarize himself with the Regulations.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Regulations are available on the Store&#8217;s website.<\/span><\/li>\n<\/ol>\n<h2 style=\"color: #141414; font-family: 'Poppins', Sans-serif; font-size: 22px; font-weight: 500; margin: 32px 0 20px 0;\">II. DEFINITIONS <\/h2>\n<p style=\"margin: 0 0 16px 0; color: #555555;\"><span style=\"font-weight: 400; color: #555555;\">Whenever the Regulations refer to:<\/span><\/p>\n\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Regulations: Online Store Regulations;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Vendor: <strong style=\"color: #222222;\">Grupa neon sp. z o.o. <\/strong> adres Unis\u0142aw 22\/8, 71-413 Szczecin, Polska NIP <strong style=\"color: #222222;\">9552472753<\/strong> REGON 380736583, wpisan\u0105 do Krajowego Rejestru S\u0105dowego pod numerem 0000739975;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Customer: a natural person who is 18 years of age or older and has full legal capacity, a legal person and an organizational unit without legal personality, but able to acquire rights and incur obligations in its own name, who enters into a legal relationship with the Seller in the scope of the Store&#8217;s activities. A Customer is also a Consumer, if there are no separate provisions for the Consumer in a given matter; <\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Entrepreneur: an individual, legal entity or organizational unit with legal capacity that enters into a legal transaction in the course of its business or independent professional activity.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Consumer: A customer who is a natural person making a legal transaction (purchase) with the Seller, not directly related to his\/her business or professional activity;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Electronic Service &#8211; a service within the meaning of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws 2017.1219, as amended), provided electronically by the Seller to the Customer via the Website;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Store or Online Store, or Service: an electronic service, Online Store, operated by the Seller at the following web address <a style=\"color: #555555; text-decoration: underline;\" href=\"https:\/\/druknabiothane.pl\/en\/\">https:\/\/druknabiothane.pl<\/a>, whereby the Customer enters into a contract of sale at a distance, the parties are informed of the sale by an automatically generated e-mail, and the performance of the contract (in particular, the delivery of the Goods) takes place outside the Internet;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Account &#8211; Electronic Service, marked with an individual name (login) and password provided by the Customer, a collection of resources in the Seller&#8217;s ICT system, in which data provided by the Customer and information about activities within the Store are collected;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Goods or Product &#8211; goods sold in the Store, offered by the Seller;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Proof of purchase &#8211; it should be understood as confirmation of the conclusion of the Agreement between the Seller and the Customer, e.g. in the form of a bill, invoice or confirmation of payment.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Contract &#8211; it should be understood as the Contract for sale of Goods offered by the Seller, concluded without the simultaneous presence of the Parties using the telecommunications network;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Delivery &#8211; it should be understood as the type of transportation service with the identification of the carrier (courier company) and its cost.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Delivery costs &#8211; it should be understood as the charges for delivery of Goods to the Customer specified on the page of each product offered by the Seller.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Form &#8211; a script that is a means of electronic communication, which allows you to place an Order in the Store or perform other actions in the Store;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Order &#8211; an instruction to purchase Goods placed by the Customer by means of technical communication;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Newsletter &#8211; Electronic Service, an electronic distribution service provided by the Seller via electronic mail (e-mail), which allows all Customers using it to automatically receive periodic messages (newsletters) from the Seller, containing information about the Service, including news or promotions in the Store.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Force majeure &#8211; is an event that is sudden, unforeseeable and beyond the control of the parties, making it impossible to perform the contract in whole or in part at all or for a certain period of time, which could not have been prevented or counteracted with due diligence (e.g., war, strikes, layoffs, shortages of raw materials or energy supplies, factory disruptions, roadblocks, extraordinary natural phenomena, epidemics, states of emergency).<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Cart value &#8211; the value of the products in the cart without additional costs, such as delivery, packaging, etc.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Progressive discount &#8211; a discount that changes its amount depending on the value of the shopping cart.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Amount discount &#8211; a discount converted to a percentage and rounded to two decimal places &#8211; required by accounting. For example, if there are two products in the cart with a total amount of PLN 100.01, and the discount is to be PLN 100, it will not be known how much each product costs separately. Therefore, the amount of the discount may be minimally different from that given in the example.  <\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Discount &#8211; a reduction in the price of products according to the current campaign on the website. Discount does not include gift cards and discounted products. <\/span><\/li>\n<\/ul>\n<h2 style=\"color: #141414; font-family: 'Poppins', Sans-serif; font-size: 22px; font-weight: 500; margin: 32px 0 20px 0;\">III. BASIC AND TECHNICAL INFORMATION <\/h2>\n<ol style=\"color: #555555; margin: 0 0 0 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Vendor&#8217;s data for contacting the customer:<\/span><\/li>\n<\/ol>\n<ul style=\"list-style: none; color: #555555; margin: 12px 0 24px 0; padding: 0;\">\n \t<li><strong style=\"color: #222222;\">druknabiothane.pl<\/strong><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\">addres Unis\u0142aw 22\/8, 71-413 Szczecin, Polska<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\">e-mail: sklep@druknabiothane.pl<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\">phone number: xxxx<\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"2\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller offers the following types of Electronic Services:<\/span><\/li>\n<\/ol>\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Online Shop<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Newsletter<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Account<\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"3\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller provides Electronic Services in accordance with the Terms and Conditions.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> A technical condition for using the Store is that the Customer must have a computer or other devices that allow browsing the Internet, appropriate software (including an Internet browser), Internet access and a current and active e-mail account.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> It is prohibited for the Customer to provide unlawful content.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The use of the Store may involve risks typical of Internet use, such as spam, viruses, hacking attacks. The Seller takes measures to counteract these threats. The Seller points out that the public nature of the Internet and the use of services provided electronically may be associated with the risk of obtaining or modifying Customer data by unauthorized persons, so Customers should use appropriate technical measures to minimize the aforementioned risks, including anti-virus and identity protection programs for Internet users.  <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The contract for free Electronic Services is concluded through the Store via the Internet. The Client may terminate the use of free Electronic Services at any time by leaving the Store or by deleting the Client&#8217;s account. In such a case, the contract for free Electronic Services will automatically terminate without the need for additional statements from the parties.  <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller may &#8211; in addition to other cases under the law &#8211; process the following personal data of the Customer necessary to establish, shape the content, change or terminate the contract:<\/span>\n<ul style=\"color: #555555; margin: 12px 0 12px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Customer&#8217;s name and first names;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">permanent residential address;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">mailing address, if different from the residential address;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Customer email addresses;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">phone number;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">name and nip of the company<\/span><\/li>\n<\/ul>\n<\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller may process, with the consent of the Customer and for the purposes of advertising, market research and customer behavior and preferences with the purpose of using the results of this research to improve the quality of services provided by the Seller, other data relating to the Customer that are not necessary for the provision of electronic services.<\/span><\/li>\n<\/ol>\n<h2 style=\"color: #141414; font-family: 'Poppins', Sans-serif; font-size: 22px; font-weight: 500; margin: 32px 0 20px 0;\">IV. PERSONAL DATA <\/h2>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"1\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller processes personal data provided by Customers in accordance with applicable laws, including Regulation (EU) 2016\/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and repealing Directive 95\/46\/EC (General Data Protection Regulation) (OJ L 119 of 4.5.2016, hereinafter: \u201cRegulation\u201d). <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> It is the Vendor&#8217;s job to make the data:<\/span><\/li>\n<\/ol>\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">processed lawfully, fairly, and transparently for Customers and other data subjects;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">collected for specific, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">adequate, relevant and limited to what is necessary for the purposes for which they are processed;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">correct and updated as necessary;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">kept in a form that allows identification of the data subject for no longer than necessary for the purposes for which the data are processed;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">processed in a manner that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organizational measures,<\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"3\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller shall apply appropriate technical and organizational measures to ensure the protection of the processed personal data appropriate to the nature, scope, context and purposes of the processing and the risk of violation of the rights or freedoms of natural persons;<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Vendor shall provide access to personal data and the exercise of other rights to Customers and other data subjects in accordance with the applicable laws in this regard.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The basis for the processing of personal data is the consent of the Customers or the occurrence of another premise authorizing the processing of personal data according to the Regulation.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The vendor guarantees the exercise of the rights of persons whose personal data is processed under the terms of the relevant legislation, including those persons are entitled to:<\/span><\/li>\n<\/ol>\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The right to withdraw consent on the processing of personal data;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The right to information regarding their personal data;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; margin: 0 0 24px 22px; padding: 0;\" start=\"7\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> A person with access to personal data shall process them only on the basis of the Seller&#8217;s authorization or a contract for entrustment of personal data processing and only on the instructions of the Seller.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller assures that it does not make personal data available to other entities than those authorized under applicable law, unless required by European Union or Polish law.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> In connection with its business activities, the Seller uses the services of other entities, including for the performance of contracts. A link will be sent to the Customer&#8217;s e-mail address provided by the Customer in the Account registration process, which will allow verification of the Account. Logging into the Account consists in providing the login and password established by the Client. SALE <\/h2>\n<h3 style=\"color: #222222; font-size: 24px; font-weight: bold; margin: 0 0 16px 0;\">Goods<\/h3>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> All Products offered in the Store are new and have no defects. A detailed description of the Goods can be found on the Store&#8217;s website. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Goods may be covered by a warranty or after-sales services. Detailed information in this regard is provided in the following sections of the Terms and Conditions. <\/span><\/li>\n<\/ol>\n<h3 style=\"color: #222222; font-size: 24px; font-weight: bold; margin: 24px 0 16px 0;\">Orders and their processing<\/h3>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> An order can be placed through the Form, available in the Store.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Orders can be placed after registering an Account with the Store or without registering an Account with the Store (shopping without registration).<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The customer is obliged to fill out the Form, providing all data in accordance with the facts and specifying the chosen method of payment and delivery.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The customer provides data in the Form and makes declarations on acceptance of the Regulations, processing of personal data, transmission of commercial information for the purpose of order processing.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Orders in the Store can be placed 24 hours a day, 7 days a week. Orders placed on Saturdays, Sundays or holidays are processed on the next business day. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Confirmation of the Order is made by the Customer by selecting the button (box) marked \u201corder with obligation to pay\u201d. The Seller will send the Customer a confirmation of the Order to the e-mail address indicated by the Customer. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Order processing time (i.e. until the day of shipment of the Goods) is up to 10 working days and is calculated from the moment of positive verification of payment.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> In the event of a request to document a transaction in the form of a VAT invoice, the Customer shall provide the necessary data, whereby the indication of the Customer&#8217;s VAT number for the invoice shall be made no later than when placing the Order. The Seller shall not be liable for incorrect or incomplete data, including VAT number, provided by the Customer. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> In case of inability to complete the order, which may take place in case of force majeure or other reasons, the Seller undertakes to immediately inform the Consumer via e-mail address or by phone. In such a case, the Consumer may cancel the execution of the contract, and the Seller will refund the fees paid by the Consumer. The price of the Goods does not include the costs referred to in section 2 below. The price of the Goods given at the moment of placing the Order by the Customer is binding for both parties.  <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The costs associated with the delivery of the Goods (e.g., transportation, delivery, postal services) and any other costs shall be borne by the Customer. If the Customer fails to make payment within this period, then &#8211; in accordance with Article 491 \u00a7 1 of the Civil Code (Journal of Laws 2017.459 t.j., as amended) &#8211; the Seller will set an additional deadline for payment to the Customer, after the ineffective expiration of which he will be entitled to withdraw from the contract. If the Customer declares that the performance will not be fulfilled, the Seller may withdraw from the contract without setting an additional deadline, also before the arrival of the specified deadline for performance.   <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The entity providing the electronic payment service is Autopay S.A., based in Sopot at Powsta\u0144c\u00f3w Warszawy 6, Supervision over the performance of payment services is exercised by the Financial Supervision Commission. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The entity providing electronic payment service is PayPro SA, Poznan, based in Poznan at Pastelowa 8 Street, Supervision of the performance of payment services is exercised by the Financial Supervision Commission. <\/span><\/li>\n<\/ol>\n<h3 style=\"color: #222222; font-size: 24px; font-weight: bold; margin: 24px 0 16px 0;\">Delivery<\/h3>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The product is shipped to the address indicated by the Customer in the Form, unless otherwise agreed by the Parties.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Product is delivered either via courier service or via postal operator at the Customer&#8217;s choice. The parcel sent through the postal operator shall be delivered within 14 working days from the date of shipment of the Product, while the parcel sent through the courier company shall be delivered within 3 working days from the date of shipment of the Product. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> It is not possible to pick up the Goods in person.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Along with the Goods, the Vendor shall issue to the Customer all items of its equipment, as well as instructions for operation, maintenance and other documents required by generally applicable laws.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The vendor indicates that:<\/span><\/li>\n<\/ol>\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">upon delivery of the Goods to the Customer or the carrier, the benefits and burdens of the Goods and the danger of accidental loss of or damage to the Goods shall pass to the Customer.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">In a sale to a Consumer, the danger of accidental loss of or damage to the Goods shall pass to the Consumer upon delivery of the Goods to the Consumer. Issuance of the Goods is considered to be its entrustment by the Seller to the carrier, if the Seller had no influence on the choice of the carrier by the Consumer, <\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\">\n<ul style=\"color: #555555; margin: 12px 0 12px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #555555;\">the damage was found by protocol before acceptance of the shipment;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #555555;\">such determination was omitted through the fault of the carrier;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #555555;\">the loss or damage resulted from the intentional fault or gross negligence of the carrier;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #555555;\">damage that is not outwardly observable, the entitled person found after acceptance of the shipment and within 7 days requested to determine the condition of the shipment and proved that the damage occurred between acceptance of the shipment for transportation and its release. Customer&#8217;s acceptance of the shipment of Goods without reservation shall extinguish claims for loss or damage in transit, unless:<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"6\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> If the customer did not pick up the goods that were shipped by the Store, the customer will be required to pay the costs associated with redelivery. Such action is in accordance with the Decree of the Minister of Infrastructure of January 9, 2004, which in \u00a7 37 stipulates that a fee is charged for activities related to the transfer of a registered parcel or postal order to the sender (after exhausting attempts to deliver or issue to the recipient). In a situation where a parcel is returned to the Store and it is not possible to contact the Customer, the parcel will be kept for a period of one month. After this period, the contents of the shipment become the property of the Store, and previously made payments are not refundable.   <\/span><\/li>\n<\/ol>\n<h3 style=\"color: #222222; font-size: 24px; font-weight: bold; margin: 24px 0 16px 0;\">Additional information for the Consumer<\/h3>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The contract is not for an indefinite period and will not be subject to automatic renewal.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The minimum duration of the Consumer&#8217;s obligations under the Contract is the time of execution of the Contract, i.e. payment and receipt of the Goods. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The use of the Store by the Consumer is not connected with the obligation to make a deposit or provide other financial guarantees.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The seller is not obliged to and does not apply the code of good practices referred to in Article 2(5) of the Act on Counteracting Unfair Market Practices of August 23, 2007 (Journal of Laws 2017.2070, as amended).  <\/span><\/li>\n<\/ol>\n<h2 style=\"color: #141414; font-family: 'Poppins', Sans-serif; font-size: 22px; font-weight: 500; margin: 32px 0 20px 0;\">VII. Care and maintenance of products with UV printing <\/h2>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> UV-printed products are durable and resistant to daily use, but proper care must be observed to maintain the aesthetics and functionality of the product.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Care principles:<\/span><\/li>\n<\/ol>\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Clean the product with mild agents, such as soapy water.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Do not use aggressive chemicals, bleach or solvents.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The product should not be washed in a washing machine or mechanically dried.<\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"3\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Usage Restrictions:<\/span><\/li>\n<\/ol>\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">Intense scratching, scrubbing against hard surfaces, such as concrete or asphalt, can lead to damage to the print.<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">With intense pulling by the dog, the print may become cracked.<\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"4\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The seller is not responsible for damage to the product caused by non-compliance with the rules of care and intensive use beyond the usual purpose of the product.<\/span><\/li>\n<\/ol>\n<h2 style=\"color: #141414; font-family: 'Poppins', Sans-serif; font-size: 22px; font-weight: 500; margin: 32px 0 20px 0;\">VIII. LIABILITY <\/h2>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Liability under warranty is excluded in legal relations with customers.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller is responsible to the Consumer if the Goods have a physical or legal defect (warranty) under the rules set forth in the provisions of the Civil Code (Journal of Laws 2017.459 t.j. as amended) and the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2017.683 t.j. as amended), including the following:<\/span><\/li>\n<\/ol>\n<p style=\"margin: 0 0 16px 0; color: #555555;\"><span style=\"font-weight: 400; color: #555555;\">A physical defect consists in the non-conformity of the Goods with the contract. In particular, the Goods are inconsistent with the contract if: <\/span><\/p>\n\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The goods do not have the characteristics that a thing of this kind should have due to the purpose specified in the contract or resulting from the circumstances or purpose;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The goods do not have the properties that the Seller assured the Consumer of;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The goods are not suitable for the purpose about which the Consumer informed the Seller at the conclusion of the contract, and the Seller did not object to such purpose;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The goods were delivered to the Consumer in an incomplete state.<\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"3\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Goods have a legal defect if the Goods are the property of a third party or if they are encumbered with a right of a third party, as well as if the restriction on the use or disposal of the Goods results from a decision or ruling of a competent authority; in the case of the sale of a right, the Seller is also responsible for the existence of the right;<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller shall be liable under warranty for physical defects that existed at the time when the danger passed to the Consumer or arose from a cause inherent in the Goods at the same time.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller is exempt from liability under the warranty if the Consumer knew about the defect at the time of the conclusion of the contract;<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> If a physical defect is discovered before the expiration of one year from the date of delivery of the Goods, the defect or its cause is presumed to have existed at the time the danger passed to the Consumer;<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller shall be liable under the warranty if the physical defect is discovered before the expiration of two years from the date of issuance of the Goods to the Consumer, and if the Goods purchased by the Consumer is a used movable item, the Seller shall be liable under the warranty if the physical defect is discovered before the expiration of one year from the date of issuance of the Goods;<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The rights of the Consumer under the warranty are:<\/span><\/li>\n<\/ol>\n<ul style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">demand to reduce the price of the Goods or withdraw from the contract, unless the Seller immediately and without undue inconvenience for the Consumer will replace the defective item with a defect-free one or remove the defect;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">The Consumer, may instead of the removal of the defect proposed by the Seller, demand the replacement of the Goods with a defect-free one, or instead of the replacement of the Goods, demand the removal of the defect, unless bringing the Goods into conformity with the contract in the manner chosen by the Consumer is impossible or would require excessive costs in comparison with the manner proposed by the Seller. In assessing the excessive cost, the value of the defect-free item, the type and significance of the defect found, and the inconvenience to which the Consumer would be exposed by another method of satisfaction shall be taken into account; <\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"9\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> A consumer who exercises warranty rights is obliged, at the Seller&#8217;s expense, to deliver the defective thing to the place specified in the contract, and if such a place is not specified in the contract &#8211; to the place where the thing was delivered to him.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The product, which will be mechanically processed by, among other things, cutting, gluing and the like, is not subject to return and claim.  <\/span><\/li>\n<\/ol>\n<h2 style=\"color: #141414; font-family: 'Poppins', Sans-serif; font-size: 22px; font-weight: 500; margin: 32px 0 20px 0;\">IX. COMPLAINTS PROCEDURE<\/h2>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Complaints should be addressed by the Customer to the Seller in writing to the address: Unis\u0142awy 22\/8, 71-413 Szczecin. The Customer may use the complaint template available in the Store, but this is not a condition for processing the complaint. <\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> If the shipment with the Goods is found to be tampered with, suffered loss or damage, the Customer should immediately (no later than within 7 days of receipt of the shipment) file a claim with the Seller. Such action will enable the claim to be asserted against the carrier. ODST\u0104PIENIE OD UMOWY<\/h2>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Withdrawal from the Contract by the Seller or the Customer may be carried out under the terms of the Civil Code (Journal of Laws 2017.459 t.j., as amended).<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The consumer has the right to withdraw from the Contract within 14 days of receipt of the Goods.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\"> Information on cancellation of the Contract by the Consumer is contained in the instructions on the right of withdrawal, available on the Store&#8217;s website.<\/span><\/li>\n \t<li><span style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">in which the Goods are alcoholic beverages, the price of which was agreed upon at the conclusion of the Contract, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the Seller has no control;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">in which the Consumer expressly requested that the Seller come to him to perform urgent repair or maintenance; if the Seller provides additional services other than those requested by the Consumer, or provides things other than spare parts necessary to perform repair or maintenance, the right to withdraw from the Agreement is granted to the Consumer with respect to additional services or things;<\/span><\/li>\n \t<li style=\"font-weight: 400; color: #555555;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #555555;\">delivery of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the Consumer before the expiry of the deadline for withdrawal from the contract and after the Seller has informed him of the loss of the right to withdraw from the contract.<\/span><\/li>\n<\/ul>\n<ol style=\"color: #555555; margin: 0 0 24px 22px; padding: 0;\" start=\"5\">\n \t<li><span style=\"font-weight: 400; color: #555555;\"> The Seller shall immediately, no later than within 14 days from the date of receipt of the Consumer&#8217;s statement of withdrawal from the contract, return to the Consumer all payments made by him, including the cost of delivering the Goods.
